Copyright & DMCA Takedown Policy

artbase ("we", "us", or "our") respects the intellectual property rights of others and expects our users to do the same. We respond to clear notices of alleged copyright infringement in accordance with the notice-and-takedown process modelled on the U.S. Digital Millennium Copyright Act (the "DMCA").

This page explains how to report copyright infringement. It is not legal advice. Submitting a takedown notice has legal consequences, and knowingly making a material misrepresentation may expose you to liability. If you are unsure whether material is infringing, seek independent legal advice before filing.


If you believe content on artbase infringes a copyright you own or are authorized to act for, submit a takedown notice using our online form:

Using the form is the fastest way to have a notice actioned, because it collects every element a valid notice requires. If you cannot use the form, you may email the same information to support@artbase.au.

What a valid notice must include

To be effective, your notice must contain all of the following:

  1. Identification of the copyrighted work you claim has been infringed (a description, and where possible a link to the original).
  2. Identification of the infringing material and information reasonably sufficient to let us locate it: the full artbase URL(s) of the artwork or profile.
  3. Your contact information: full legal name, mailing address, telephone number, and email address.
  4. A good-faith-belief statement: that you believe the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy and authority: that the information in your notice is accurate, and that you are the copyright owner or are authorized to act on the owner's behalf.
  6. Your electronic signature: your full legal name, typed as your signature.

The online form captures each of these and records the two declarations for our records.


What happens next

  1. We acknowledge receipt of your notice by email to the address you provide.
  2. We review the notice. If it is valid and complete, we take appropriate action, which may include removing or disabling access to the material and notifying the user who posted it.
  3. We may contact you if we need clarification or additional information.

We do not disclose more of your notice than necessary to process it, but the user whose content is affected may be given a copy of the notice (including your identity) so they can respond or file a counter-notice.


Counter-notification

If your content was removed or disabled and you believe this was a mistake or misidentification, you may send a counter-notice to support@artbase.au containing:

  1. Your name, address, telephone number, and email address.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury (or equivalent good-faith declaration), that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the party who filed the original notice.
  5. Your electronic signature.

If we receive a valid counter-notice, we may restore the removed material unless the original complainant notifies us that they have filed a legal action seeking to restrain the allegedly infringing activity.


Repeat infringers

Consistent with our Terms of Service, artbase maintains a policy of disabling or terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
